BuildersPass Terms of Service

1. PLATFORM DESCRIPTION
BuildersPass LLC ("BuildersPass," "we," "us") operates an online directory platform at builderspass.com connecting construction subcontractors with project developers and government agencies. BuildersPass is a marketplace platform only. We do not employ, supervise, endorse, or guarantee the work of any listed contractor or developer.
2. NO EMPLOYMENT OR AGENCY RELATIONSHIP
BuildersPass is not an employer, staffing agency, contractor, or general contractor. Listing on BuildersPass does not create any employment, agency, partnership, or joint venture relationship between BuildersPass and any user.
3. INDEPENDENT VERIFICATION REQUIRED
Users must independently verify all credentials, licenses, insurance, certifications, and qualifications of any contractor before entering into any agreement. BuildersPass verification badges confirm only that documents were reviewed at the time of application. Licenses and insurance expire. Users assume all risk of hiring.
4. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDERSPASS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, PROPERTY DAMAGE, PERSONAL INJURY, OR PROJECT DELAYS, ARISING FROM USE OF THIS PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE MEMBERSHIP FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
5. USER REPRESENTATIONS
By joining, users represent that: all information submitted is accurate; they have authority to bind their company; they will maintain current licenses and insurance; they will update their profile if any information changes; they will not submit false reviews.
6. REVIEW POLICY
Reviews may only be submitted after a confirmed placement through BuildersPass. Reviews reflect the opinion of the reviewer. BuildersPass is not responsible for review content under Section 230 of the Communications Decency Act, 47 U.S.C. § 230.
7. MEMBERSHIP FEES
Fees are billed annually and non-refundable after the 7-day cancellation period. BuildersPass may revoke membership for Terms violations without refund.
8. GOVERNING LAW
These Terms are governed by Florida law. Disputes shall be resolved by binding arbitration in Miami-Dade County, Florida under AAA rules.
9. CHANGES TO TERMS
We may update these Terms at any time. Continued use after notice of changes constitutes acceptance.
